PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY. BY ACCESSING THE CAMPGRID WEBSITE, MOBILE APPLICATIONS, OR UTILIZING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE LEGAL PROTOCOLS. IF YOU DO NOT AGREE, DISCONNECT FROM THE GRID IMMEDIATELY.
The Briefing: Here is a summary
● We are the Platform, not the Provider: CampGrid provides the technology, the audits, and the marketplace. We do not own the 4x4s or the campsites. Your service contract is directly with the Vendor or Agent you book.
● Audits are Snapshots: Our 20-Point Safety Audit ensures a high standard at the time of inspection. However, mechanicals happen and nature shifts. Always perform your own “Grit Check” before heading out.
● You are the Commander: Overlanding is inherently risky. By using the Grid, you accept that you are responsible for your own safety. CampGrid is not liable for “acts of God,” flat tires, or mountain-side mishaps.
● Your Data is Shielded: We follow the DPDP Act (2023). We track your GPS during trips for one reason only: to find you if things go south. Your data belongs to you.
1. DEFINITIONS AND INTERPRETATION
● “The Grid” refers to the digital infrastructure, listing portal, and marketplace owned and operated by CampGrid.
● “Guest” refers to any individual (Data Principal) accessing the website or booking services.
● “Stakeholders” includes Vendors (Fleet/Campsite Owners), Suppliers (Gear), Associates, and Agents (Navigators).
● “Verified Listing” refers to an asset that has cleared the CampGrid 20-point Safety Audit.
2. NATURE OF THE PLATFORM (THE INTERMEDIARY ROLE)
CampGrid operates as an Aggregator and Technology Infrastructure Provider.
● Independent Entities: All services (vehicles, guides, campsites) are owned and operated by third-party Vendors.
● No Vicarious Liability: CampGrid does not own, operate, or control the physical assets. The contract for service delivery is a direct bipartite agreement between the Guest and the Vendor/Agent.
3. USER ELIGIBILITY AND ACCOUNT SECURITY
● Competency: Users must be at least 18 years of age and possess the legal authority to enter into a binding agreement.
● Account Integrity: You are responsible for maintaining the confidentiality of your credentials.
4. THE AUDIT STANDARD (GROUND TRUTH)
● Snapshots: Our audits are snapshots in time. While we certify that an asset met the “Grid Standard” on the date of inspection, CampGrid is not responsible for mechanical degradation or environmental changes that occur post-audit.
● User Prudence: Guests are encouraged to perform their own “Grit Check” upon arrival at any campsite or vehicle handover.
6. DATA PROTECTION (DPDP ACT 2023 COMPLIANCE)
● Data Processing: We process personal data solely for the purpose of facilitating expeditions and safety monitoring.
● Sovereignty: You retain all rights to access, correct, or erase your data as outlined in our Privacy Policy.
7. LIMITATION OF LIABILITY (THE SHIELD)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPGRID, ITS DIRECTORS, AND ASSOCIATES SHALL NOT BE LIABLE FOR:
● Any physical injury, loss of life, or damage to personal property occurring in the wild.
● Service failures, delays, or “Force Majeure” events (landslides, flash floods, political unrest).
● Indirect, incidental, or punitive damages arising from the use of the portal or vendor services.
8. CODE OF CONDUCT AND INDEMNIFICATION
● Zero-Jugaad Policy: Users and Vendors agree not to bypass the platform for “off-grid” bookings.
● Indemnity: You agree to indemnify and hold CampGrid harmless from any claims, losses, or legal fees resulting from your violation of these Terms or your negligent behavior during an expedition.
9. INTELLECTUAL PROPERTY
All technical specifications, custom UI/UX elements, badge designs, and the Master Content Library are the exclusive property of CampGrid. Unauthorized duplication of our “Technical Topography” is strictly prohibited.
10. GOVERNING LAW AND DISPUTE RESOLUTION
● Jurisdiction: These Terms are governed by the laws of the Republic of India.
● Arbitration: Any dispute arising out of or in connection with these Terms shall be settled by a sole arbitrator appointed by CampGrid, with the seat of arbitration being Navi Mumbai, Maharashtra.
11. MODIFICATIONS TO THE GRID
CampGrid reserves the right to “Recalibrate” these Terms at any time. Significant changes will be signaled via your registered email. Continued use of the platform after such updates constitutes acceptance of the new protocols.
